Effective Date: August 11, 2026
Welcome to Ziafex Creations & Collectibles. These Terms & Conditions govern your use of ziafex.com and purchases made through the website.
By placing an order, submitting a custom-work request, or otherwise using this website, you agree to these Terms & Conditions and any policies referenced here, including our Refund and Returns Policy and Privacy Policy.
1. About Ziafex
Ziafex Creations & Collectibles sells a combination of:
- Collectibles and resale merchandise
- Convention and SDCC exclusives
- Convention swag and promotional items
- Limited-edition and one-of-a-kind items
- Ziafex-made products
- 3D-printed products
- Laser-engraved and personalized products
- Custom cosplay helmets, props, and other commissioned work
Some merchandise sold by Ziafex is manufactured or distributed by third parties. Unless specifically stated otherwise, the sale of a third-party collectible does not imply sponsorship, endorsement, authorization, or affiliation between Ziafex and the manufacturer, brand, studio, publisher, convention, or intellectual-property owner.
2. Product Listings and Condition
We make reasonable efforts to describe products accurately and provide photographs that fairly represent the item being sold.
Because many products are collectibles, convention items, previously handled merchandise, limited releases, or one-of-a-kind pieces, condition may vary.
When condition is important, the individual product listing controls. Customers should review the description and photographs before purchasing.
Packaging may occasionally show minor wear from manufacturing, shipping, convention distribution, storage, or handling. Material packaging damage or known defects will be disclosed when reasonably identifiable.
Colors may appear somewhat different depending on lighting, photography, monitor settings, materials, printing methods, paint, or hand-finishing.
3. Availability and Limited Items
Many Ziafex products are available in limited quantities and may not be replaceable.
Adding an item to a shopping cart does not reserve the item.
An order is subject to acceptance and product availability. If inventory is incorrect, an item is unavailable, or we are unable to fulfill an order, we may cancel the affected item and issue a refund to the original payment method.
4. Pricing
Prices are displayed in U.S. dollars unless otherwise stated.
We may change prices at any time before an order is placed.
If a product is accidentally listed with a clearly incorrect price, description, shipping charge, or other material error, we may contact you before fulfillment to correct the issue. If the order cannot be fulfilled under the corrected terms, the affected purchase will be canceled and refunded.
Applicable sales tax and shipping charges are calculated during checkout where required.
5. Payment
Payment is required using one of the payment methods offered at checkout.
Orders may be subject to payment authorization, fraud screening, identity verification, or other security measures provided by our payment processor.
We reserve the right to decline or cancel an order when reasonably necessary to prevent suspected fraud, unauthorized use, payment abuse, or other unlawful activity.
6. Custom Work and Made-to-Order Products
Custom work may include cosplay helmets, props, 3D printing, engraving, painting, finishing, personalized merchandise, and other fabrication services.
Before custom production begins, we may provide a quote describing the project, price, estimated timeframe, specifications, and any required deposit.
A quote is not an acceptance of a project until we confirm the order.
Custom projects may require:
- Reference photographs or artwork
- Measurements or sizing information
- Color and finish selections
- Design approval
- Material selection
- Deposit or advance payment
Customers are responsible for reviewing specifications and approvals carefully before production begins.
7. Custom Order Deposits and Cancellations
If a custom project requires a deposit, the refundable or non-refundable nature of that deposit will be disclosed before payment.
Before fabrication begins, a custom order may generally be canceled unless project-specific materials, files, supplies, components, licensing, or other expenses have already been incurred.
Once printing, engraving, fabrication, personalization, painting, finishing, assembly, or other custom production has begun, cancellation for change of mind may no longer be available.
Custom and personalized products are subject to the Custom Products provisions of our Refund and Returns Policy.
8. Custom Work Variations
Handmade, hand-finished, 3D-printed, painted, engraved, and customized products may contain minor variations that are normal to the fabrication process.
Small differences in color, texture, layer lines, surface finish, positioning, paint application, or other handmade characteristics are not necessarily defects.
We will make reasonable efforts to produce custom work consistent with the agreed specifications and approved references.
9. Customer-Supplied Artwork, Logos, and Designs
If you provide artwork, photographs, logos, names, trademarks, characters, files, designs, or other materials for use in a custom project, you represent that you have the right or permission necessary for Ziafex to use those materials for your requested project.
Ziafex may decline a project if we reasonably believe it would infringe another party’s rights, violate law, create a safety concern, or otherwise be inappropriate for us to produce.
Submitting a custom request does not require Ziafex to accept the project.
10. Intellectual Property
The Ziafex name, website design, original photographs, original written content, and original Ziafex-created designs are protected to the extent provided by applicable intellectual-property law.
Third-party product names, logos, characters, trademarks, artwork, and other intellectual property remain the property of their respective owners.
Purchase of a physical product does not transfer ownership of any underlying third-party copyright, trademark, character, logo, or other intellectual-property right.
11. Cosplay Helmets and Props
Unless a product listing expressly states otherwise, cosplay helmets, armor, props, and similar Ziafex-made products are intended for costume, display, collectible, or recreational use.
They are not motorcycle helmets, construction helmets, sports helmets, ballistic equipment, impact-protection devices, respiratory equipment, or other certified safety equipment.
Do not rely on a costume or cosplay item for protection from impact, heat, fire, chemicals, vehicles, weapons, hazardous environments, or other safety risks unless the product is expressly sold and certified for that specific purpose.
12. Shipping
We currently ship to eligible addresses within the United States.
Shipping prices and available methods are displayed during checkout.
Customers are responsible for providing a complete and accurate delivery address.
Shipping and production dates shown on product pages, quotes, or order communications are estimates unless expressly stated as guaranteed.
If an order cannot be shipped within the timeframe promised, we will handle the delay and any cancellation or refund rights in accordance with applicable law.
Tracking information will be provided when available.
13. Lost, Damaged, or Incorrect Shipments
If an order arrives damaged, defective, materially different from its listing, or contains the wrong item, contact us as soon as reasonably possible.
Please retain:
- The merchandise
- Shipping box
- Packing materials
- Shipping label
- Photographs showing the condition of the package and item
We may need this information to evaluate the issue or submit a carrier claim.
Please refer to our Refund and Returns Policy for additional details.
14. Returns and Refunds
All returns, exchanges, damaged-item claims, custom-product returns, cancellations, and refunds are governed by the Ziafex Refund and Returns Policy posted on this website.
Certain custom, personalized, engraved, made-to-order, limited, or clearly marked Final Sale products may not be returnable for change of mind.
Nothing in these Terms eliminates rights or remedies that cannot legally be waived.
15. Order Cancellations
Standard merchandise orders may be eligible for cancellation before fulfillment begins.
Once an order has been packed, shipped, or otherwise entered fulfillment, cancellation may no longer be possible and the return policy will apply instead.
Custom orders are governed by the custom-order cancellation provisions above.
16. Payment Disputes and Chargebacks
If you believe there is a problem with an order or charge, please contact Ziafex first so we have an opportunity to investigate and resolve the issue.
Nothing in this section prevents you from exercising any legally available rights through your card issuer, bank, payment provider, or consumer-protection law.
Submitting knowingly false information or fraudulent payment disputes may result in refusal of future orders and any other remedies available under applicable law.
17. Website Use
You may use this website only for lawful purposes.
You may not intentionally:
- Attempt unauthorized access to the website or its systems
- Interfere with website security or operation
- Introduce malicious software
- Use automated systems to abuse checkout, inventory, promotions, or account functions
- Submit fraudulent orders or payment information
- Use the website to violate another person’s legal rights
We may restrict website access or cancel accounts or orders where reasonably necessary to address fraud, abuse, security threats, or unlawful activity.
18. Third-Party Services
The website may use third-party services for payment processing, shipping, analytics, hosting, communications, and other functions.
Those third parties may have their own terms and privacy practices.
Ziafex is not responsible for outages or failures caused solely by third-party systems outside our reasonable control, but we remain responsible for our own obligations to customers under applicable law.
19. Disclaimer and Limitation of Liability
To the fullest extent permitted by applicable law, Ziafex will not be liable for indirect, incidental, special, or consequential damages arising solely from use of this website or a product where such damages may lawfully be excluded.
This provision does not exclude or limit liability that cannot legally be excluded or limit consumer rights provided by applicable law.
Nothing in these Terms is intended to waive protections that the law does not permit a seller to waive.
20. Governing Law
These Terms are governed by the laws of the State of California, without limiting any mandatory consumer protections that may apply under federal law or other applicable law.
21. Changes to These Terms
We may update these Terms & Conditions from time to time.
Changes apply prospectively beginning when the updated Terms are posted, unless applicable law requires otherwise.
The Effective Date at the top of this page identifies the current version.
22. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
23. Entire Agreement
These Terms, together with the applicable product listing, order confirmation, Refund and Returns Policy, Privacy Policy, and any written custom-project quote or agreement, constitute the terms applicable to the relevant transaction.
If a written custom-project quote contains terms that specifically conflict with these general Terms, the project-specific terms control for that custom project.
